Planning and Development Control Committee

 

 

Role of the Planning and development Committee

The Committee comprises every Member of the Council. The Committee is the democratic decision-making body for determining planning applications, listed buildings, advertisement and other planning matters that have not been determined by the Director of Environmental and Planning Services under delegated powers. Decisions are not taken on party political grounds.

Committee has to determine all planning matters in accordance with the framework established by the planning legislation, relevant judicial decisions, government advice and the approved Development Plan and Supplementary Planning Guidance.

The law requires planning decisions to be made in accordance with the Development Plan unless material planning considerations indicate otherwise. Members’ primary duty is to interpret and apply the Council’s approved planning policy.

The reports on planning applications to be considered by Committee are available for public inspection at the Civic Offices three days before the date of the Committee meeting.

   

Textual information about planning applications and planning decisions is to be made accessible via the Council’s website on the Planning page this summer.

   

The Council introduced public speaking at Committee from the 27th October 2005.

   

Who Is Allowed to Speak?

 

One objector will be allowed to speak at Committee and, if that right is taken up, the applicant or agent will be allowed to speak in reply:-

   

How Does the Scheme Work – For Objectors?

 

In order to speak at Committee an objector must:-

     
 

1.

Lodge an objection in writing within the period specified for receipt of representations on that application; and

     
 

2.

Register a request to speak at Committee in writing to the case officer, no later than three clear working days before the date of the Committee meeting including details of a telephone number and times when they can be contacted.

     
 

3.

It will be the responsibility of the objector to check whether the application is to be considered by Committee by contacting the case officer. The case officer will provide details of the likely date when the application will be heard and the procedure for registering the wish to speak. No guarantee will be given that an application will be determined at any particular Committee.

     
 

4.

Where more than one objector registers to speak, they will be encouraged to appoint a spokesperson. This could be a representative of the relevant town or community council. Where no agreement can be reached by the objectors the Chairman will allot the time to the first person to register.

     
 

5.

Time will be allowed for speaking after the Chairman of the meeting introduces the item.

     

How Does The Scheme Work – For Applicants/Agents?

     
 

1.

Once it is known that an objector has registered to speak against an application the applicant or agent will be notified by the planning department.

     
 

2.

If the applicant or agent wish to exercise the right of reply they must notify the case officer immediately.

     
 

3.

Time will be allowed for speaking immediately after the objector has spoken. No guarantee will be given that an application will be determined at any particular Committee nor that an objector will actually speak in which event the applicant or agent will not be able to speak.

     

How Does The Scheme Work for Town and Community Councils?

     
 

1.

Town and community councils will continue to be notified as at present of the receipt of all planning applications in their area.

     
 

2.

If they resolve to object to any application, they will be entitled to address the Planning and Development Committee.

     
 

3.

Similarly, if they resolve to support an application to which representations of objection are made to the Committee, they may speak in support.

     

Where And When Are Meetings Held?

     
   

Meetings of the Planning and Development Committee at Bridgend County Borough Council are normally held at the Civic Offices, Angel Street, Bridgend.

     
   

You are advised to arrive no later than 15 minutes before the meeting which starts at 2.00 p.m. A clerk will advise on seating and answer any other queries. Speakers should advise the Council in advance if they have any special needs.

     

What Is The Order Of Business Speaking And Time Allotted?

 

The Chairman will introduce the item and invite the following to speak and conduct business in the following order:-

     
 

1.

Objector – up to 3 minutes maximum. This limit will be observed strictly.

     
 

2.

Proponent – up to 3 minutes maximum. This limit will be observed strictly.

     
 

3.

Planning Officer to present report and recommendation.

     
 

4.

Members to consider and reach decision.

     

What Can Be Said At Committee?

 

Comments should be limited to relevant planning issues already raised in the written representations or application. These may include:-

     
 

Planning policies, including those in the Development Plan;

     
 

Appearance and character of development, layout and density;

     
 

Traffic generation, highway safety and parking;

     
 

Overshadowing, overlooking, noise disturbance or other loss of amenity.

     

Matters that cannot be considered by Committee include:-

     
 

Boundary disputes, covenants and other property rights.

     
 

Personal remarks (e.g. the applicant’s motives).

     
 

Rights to a view or potential devaluation of property

     
 

The presentation of plans, drawings or other visual aids, the taking of photographs or the use of voice recording equipment will not be permitted. Speakers may not ask questions of others at the meeting, nor will others be allowed to ask questions of them unless the Chairman wishes to seek clarification.

     

What Happens After The Committee?

 

The Committee’s decision and the reasons for it will be confirmed to applicants and objectors in writing. Normally applicants (or their agents) will be notified of the decision within three working days. Objectors will be notified within five working days of the decision notice being issued.
