What is private fostering?
Private fostering is when a child under 16 (under 18 if disabled) is cared for by an adult who is not a close relative i.e. brother/sister, aunt/uncle, grandparent, a full or half relation, a step parent or related by marriage.
It is an arrangement between the parent and a carer. It’s usually the birth parent who chooses and arranges the private foster arrangement. A child is considered to be in private foster care if they are completely cared for by someone who is not directly related, for a total of 28 days or more. The period of 28 days does not have to be continuous.
Legal Requirement
If your child is living with someone else or if you are looking after someone else’s child - in a private foster arrangement - you must let the council know as soon as possible as it’s a legal requirement.
The council has a legal requirement to ensure that all children who are being looked after by someone other than their parents are safe, well cared for and getting the services and support they need.

Using the checklist below, find out whether a current or impending arrangement comes under the private fostering regulations. If the answer to the questions below is ‘yes’ then it is likely that a private fostering arrangement is in place, and you will need to contact the council – details are below.
