Fly-tipping
Fly-tipping is the illegal disposal of any waste on land and is an offence. The main legislation relating to the keeping, treatment and disposal of waste is contained in Sections 33 and 34 of the Environmental Protection Act 1990. Anyone fly-tipping waste is committing a serious offence. |

Those found guilty of fly-tipping can be fined up to £50,000 and face up to 6 months in prison or up to five years if hazardous waste is dumped (eg toxic waste, asbestos, etc) if convicted in a Magistrates' Court. If convicted in the Crown Court, fines are unlimited and a prison sentence of up to 5 years can be imposed.
Under this legislation it is also illegal for an owner or occupier of land to allow someone to dump rubbish on land belonging to themselves if they do not have a waste management licence or an exemption for that land, with the same levels of fines being imposed upon indictment in a Crown Court.
New legislation was introduced in November 2005 under The Waste (Household Waste) Duty of Care (England & Wales) Regulations 2005, which states that householders must "take all reasonable steps to ensure that waste is only taken from their homes by operators who are authorised to do so". This means that a legal responsibility is now placed on the householder to ensure that the operator i.e. the person taking their waste away for disposal, is registered with the Environment Agency as a waste carrier. Householders must take extra care when employing traders or contractors who undertake clearance work as the householder is liable to a fine of £5,000 for failing in their 'duty of care' to pass their rubbish to a legal waste operator. How to prevent fly-tipping
The council's waste collection services may assist with disposal of bulky or difficult items as a special collection. However there may be a charge for this service. For further information on the waste collection service please phone (01656) 643468.
Any registered waste carrier can remove waste, but if using a private company it is important to ascertain the following information:

Business waste
If you are a business, you must ensure you receive a Duty of Care Waste Transfer Note from the registered waste carrier who is disposing of your waste.
