Your business and the law

Current environmental law places certain responsibilities on businesses in respect of the disposal of trade waste. This page explains the law and outlines the ways in which the council can help you to meet its requirements.

The Duty of Care was introduced under section 34 of the Environmental Protection Act 1990. It became law on the 1 April 1992 and applies to any business that produces, carries, stores or disposes of waste.

Under the Duty of Care legislation, businesses must:

Arrange the disposal of waste via an authorised waste management organisation i.e. a registered waste carrier.

Prevent the escape of waste by storing it securely.

It is a criminal offence to breach the Duty of Care and businesses convicted of this offence may be liable to meet an unlimited fine.

This means that you can be secure in the knowledge that you have satisfied your obligations in respect of the disposal of your trade waste.

Choosing a service that is right for you

The council offers a variety of collection methods. This means that we can provide a service that suits your business, at competitive rates.

Wheeled containers are available in a range of sizes. The containers are durable and come with lockable lids and brake mechanisms. The council's charge is levied in respect of size of bin and number of collections. Unlike many private waste management firms, the council levies no charge in respect of container rental. Wheeled containers are suitable for larger businesses and for pubs, restaurants and food outlets where wet or food waste is generated.

Trade sacks may be purchased from various sites throughout the county borough and are available in packs of 50. Trade waste should then be placed inside the sacks for collection. This service is ideal for small businesses generating limited quantities of waste. There are no further charges.
