Public Path Orders

A landowner, occupier or developer cannot simply move or close a path at their whim. Public Rights of Way already shown on the Definitive Map and Statement can only be altered by statutory means.

Similarly the legislation states that statutory processes must be used if landowners, occupiers or developers want to create new paths.

The different types of statutory processes include:

  • Diverting paths by Public Path Order under the Highways Act 1980
  • Extinguishing paths by Public Path Order under the Highways Act 1980
  • Creation of paths by Agreement or Order under the Highways Act 1980
  • Diverting, creating or extinguishing paths by Public Path Order under the Town and Country Planning Act 1990

If a member of the public, an organisation or the County Borough Council want to have route added to the Definitive Map and Statement because they believe that public rights have been shown to exist then a separate process exists for dealing with such applications.
